User Agreement and Terms of Service
PLEASE READ THIS USER AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.
This User Agreement ("Agreement") is a legal agreement between you, the user (referred to as "you," "your," or "User"), and Contemporary Endodontics Ltd. (referred to as "Company," "we," "us," or "our") regarding your use of the educational website, training services, and digital content offered through contemporaryendo.com (the "Platform" or "Services").
By accessing or using the Platform, registering an account, or clicking the "I Agree" button, you agree to comply with and be bound by all the terms and conditions of this Agreement.
Acceptance of Terms
By using the Services, you represent and warrant that you are a licensed dental professional or a person authorised to seek continuing dental education, and that you have the legal authority to enter into this Agreement. If you do not agree to all the terms of this Agreement, you must not use or access the Platform.
Platform Content and Educational Disclaimer
Nature of Services
The Platform provides access to educational content, including digital media, instructional videos, documents, and resources (collectively, the "Content") related to endodontic procedures and techniques. This Content is offered solely for informational and educational purposes as a supplement to professional training.
Professional Responsibility and Limitation of Liability
YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:
- Supplemental Training Only: The Content provided by the Company is intended to be an integral part, but not the entirety, of the knowledge and skills required to successfully practise endodontics and/or dentistry.
- Sole Responsibility of the Dentist: We will not verify your professional registration. You are responsible for ensuring you hold appropriate licences and insurance. You, as a registered professional, are solely responsible for:
- Determining whether the information and techniques learned through the Platform are suitable for your practice and patients;
- Exercising independent professional judgement when applying any Content or techniques in a clinical setting;
- Complying with all applicable laws, rules, professional standards of care, and regulatory requirements of the General Dental Council (GDC) or other relevant regulatory body in your jurisdiction;
- Maintaining professional competency, including continuing education beyond what is offered by this Platform (e.g., CPD).
- No Professional Advice: The Content does not constitute clinical, legal, or professional advice. Reliance on any Content for clinical treatment is undertaken at your own sole risk.
- No Guarantee of Outcome: The Company makes no guarantee that utilising the Content will result in any specific outcome, patient benefit, or prevent any adverse event.
- Indemnification: You agree to indemnify and hold the Company harmless from any claims, damages, liabilities, losses, or expenses (including legal fees) arising from your application of the Content in clinical practice, or your failure to comply with professional standards and applicable laws.
- Continuing Professional Development (CPD) or Continuing Education (CE): Where CPD/CE accreditation is stated, we will issue certificates upon completion of specified learning activities and assessments. You are responsible for maintaining your CPD/CE records and ensuring relevance to your scope of practice.
- Age and Professional Status: You confirm you are at least 18 years old, a registered dental professional or authorised trainee, and eligible to access dental education content applicable to your scope of practice.
User-Generated Content, Forums, and Feedback
- Patient Confidentiality: You must not upload any patient-identifiable information. You are solely responsible for de-identifying clinical information.
- Licence to Use Submissions: You grant the Company a worldwide, non-exclusive, royalty-free licence to host, use, reproduce, and display your submissions to provide and improve the Services.
- Content Removal: We may remove content and suspend users for breaches of acceptable use, including unlawful, defamatory, infringing, or misleading content.
Third-Party Links and Resources
Third-party sites or resources are provided for convenience. We are not responsible for their content, availability, or practices.
Account Registration and Security
You must register an account ("Account") to access the Services. You agree to:
- Provide accurate, current, and complete registration information;
- Maintain the security of your password and identification;
- Accept full responsibility for all activities that occur under your Account;
- Notify the Company immediately of any unauthorised use of your Account.
Your Account is personal to you and may not be shared or used by any other individual.
Data Security
- Data Controller Responsibilities: We act as an independent controller of personal data you provide for account and billing purposes and process personal data in accordance with our Privacy Notice.
- Patient Data Prohibition: You must not upload personal data of patients. If you do so in breach of this Agreement, you are responsible for obtaining all necessary consents and lawful bases.
- Security Measures: We use commercially reasonable efforts to protect your personal information, but we cannot guarantee absolute security. Any information transmitted to the Platform is at your own risk.
Prohibited Conduct
You must not:
- Circumvent access controls or digital rights management (DRM);
- Probe, scan, or test the vulnerability of the Services;
- Use bots or scraping tools;
- Upload malware; or
- Use the Services to compete with us or build a competing product.
Marketing Consent
With your prior consent, we may identify you or your practice as a user and use your testimonials in marketing materials.
Fees, Payment, and Cancellation
Fees
You agree to pay all fees associated with your subscription or purchase of Services ("Fees") as described on the Platform. All Fees are non-refundable unless otherwise stated or required by law.
All prices are exclusive of VAT, which will be added at the applicable rate.
You authorise us to update your payment method using information provided by our payment processors.
If payment is unsuccessful or reversed, we may suspend access until paid and charge reasonable late fees and collection costs.
Automatic Renewal and Cancellation Policy
Your subscription will automatically renew for your chosen renewal period, and you authorise us to charge the applicable recurring Fees using your saved payment method.
- Cooling-Off Period: If you are a consumer, you have 14 days to cancel a distance contract. If access to digital content begins immediately on purchase, you lose the right to cancel once delivery starts.
- Cancellation Before Renewal: You may cancel before the renewal date via your account settings. Access will cease at the end of the current billing term.
- Cancellation After Renewal: Once renewed, Fees for that Renewal Period are non-refundable. No refunds or credits are provided for partial periods.
Notices and Contract Changes
- Method of Notice: We may notify you by email or in-product messaging.
- Amendments to Terms: We may update these terms to reflect legal or service changes. If you do not agree, you must stop using the Services before changes take effect.
Intellectual Property and Limited Licence
Company Content
All Content on the Platform, including videos, text, graphics, logos, and software, is the proprietary property of the Company or its licensors and is protected by intellectual property laws.
We may modify or discontinue Content or features at any time and schedule maintenance as necessary.
Limited Licence
The Company grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and view the Content solely for your personal, non-commercial educational purposes during your active subscription.
Restrictions
You agree not to:
- Download, reproduce, distribute, transmit, sell, or exploit Content without prior written permission;
- Share login credentials or allow third-party access;
- Modify or create derivative works of Content.
We may use DRM, watermarking, and monitoring to detect unauthorised use and may seek injunctive relief where appropriate.
Termination
We may terminate or suspend your Account immediately if you breach this Agreement. Upon termination, your right to use the Services ceases immediately. No refunds are due except as required by law.
Warranty Disclaimer
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Governing Law and Jurisdiction
This Agreement is governed by the laws of England and Wales. You submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising from this Agreement or the Services.
